Road & Traffic Accidents
A road or traffic accident can happen in an instant, but the consequences can last for months, years, or even a lifetime. Whether you were driving a car, riding a motorcycle, travelling as a passenger, cycling, walking, or simply using Queensland’s roads, you may be entitled to compensation if your injuries were caused by the negligence of another road user.
Queensland’s Compulsory Third Party (CTP) insurance scheme provides compensation for people who suffer personal injuries in motor vehicle accidents caused wholly or partly by another person’s negligence. Importantly, claims are not limited to drivers. I act for people injured as drivers, motorcycle riders, pillion passengers, passengers in cars, taxis and rideshare vehicles, cyclists, pedestrians, bus passengers and, in appropriate circumstances, those injured by unidentified or uninsured vehicles through the Nominal Defendant.
Road traffic accidents occur in many different ways, including rear-end collisions, intersection crashes, failure to give way, head-on and side-impact collisions, motorcycle accidents, pedestrian impacts, bicycle collisions, reversing accidents, heavy vehicle incidents, and accidents involving taxis, buses and rideshare vehicles. Even seemingly minor collisions can result in significant injuries that affect your health, your ability to work, and your enjoyment of everyday life.
I assist clients who have suffered a broad range of injuries, including whiplash and soft tissue injuries, fractures, spinal injuries, neck and back injuries, shoulder and knee injuries, traumatic brain injuries, psychological injuries, chronic pain, scarring, and other serious or catastrophic injuries. I also assist families who have tragically lost a loved one as a result of a fatal road traffic accident.
Every claim is unique, however a successful claim generally requires evidence that another road user failed to take reasonable care and that their negligence caused your injuries and resulting loss. Even if you believe you may have contributed to the accident, you should seek legal advice. In many cases, you may still be entitled to compensation.
Compensation may include damages for pain and suffering, past and future loss of income, medical and rehabilitation expenses, treatment costs, care and assistance provided by family or professionals, travel expenses, future medical needs, and other losses resulting from your injuries.
Following a road traffic accident, it is important to seek medical attention as soon as possible, report the accident to police where required, preserve any photographs, dashcam footage and witness details, and obtain legal advice promptly. Strict time limits apply to CTP claims in Queensland, and obtaining early advice can be critical to protecting your rights and preserving important evidence.
I understand that dealing with insurers, medical treatment and financial uncertainty after an accident can be overwhelming. My role is to guide you through the process from beginning to end, explain your rights in plain English, deal with the insurer on your behalf, and ensure your claim is properly investigated and presented. My focus is on achieving the best possible outcome for you while making the process as straightforward and stress-free as possible.
